The OP applies to the sale of products and services on the resonancia.cz website, which is operated by Blue Globe.CZ, s.r.o., with registered office at Kalusova 827/10, 709 00 Ostrava-Mariánské Hory, ID:27810259, Tax ID: CZ27810259, file number C 52425, registered with the Regional Court in Ostrava (hereinafter referred to as BG-CZ)

1/ Method of payment
The online shop Blue Globe.CZ, s.r.o., allows payment by bank transfer directly to the company's account.

As a variable symbol of payment it is necessary to indicate your order number. The order will not be processed until the money is credited to our account. If the order is not paid within 4 days of ordering, the order will be cancelled.
Cash on delivery is possible for a fee of 45,- CZK. Cash on delivery is not possible for instruments and selected products.
For selected products, payment is possible only by bank transfer or online.

Online payments are provided by ComGate payment gateway. The service provider, ComGate Payments, a.s., is a licensed payment institution operating under the supervision of the Czech National Bank. Payments made through the payment gateway are fully secured and all information is encrypted.

Payment by card

The fastest way to pay online. You enter your card number, expiry date and CVC code - three numbers found in the signature strip on the back of your card - into the ComGate payment gateway interface. It's all secured with the 3D Secure standard, so you'll probably be asked to enter a numeric code, which you'll receive via text message from your bank.

Payment by bank transfer

Instant payment via online banking. The ComGate payment gateway will redirect you to your online banking, where you log in as usual and confirm the payment order you have already prepared.

After completing the payment you will be redirected back to the store. Payment is confirmed immediately, we will proceed with the order without delay.

2/ Method of delivery
Free local pickup is also possible at BG-CZ (Kalusova 827/10, Ostrava- Mariánské Hory 709 00).
Delivery by Zásilkovna.cz - to the address is 120,- CZK. The delivery price is part of the payment for the ordered goods.
When delivered by Zásilkovna.cz the delivery price is 79,- CZK.
For delivery by GLS to the address is the price of delivery 99 CZK, to the delivery point 86 CZK
GLS delivery to address - Slovakia 155 CZK (up to 10 kg)
PPL delivery to the address is 119,- CZK, to PPL branches is 89,- CZK.
We send to Slovakia using the shipping services of Zásilkovna.cz for 150,- CZK up to 5 kg and PPL for 280,- CZK up to 5 kg.
Elsewhere abroad we send goods by agreement, prices are determined individually.

3/ Transport conditions
The ordered goods are dispatched no later than the second working day after the payment for the goods is credited to the account of Blue Globe.CZ, s.r.o. (applies to payments by bank transfer).
If the ordered goods are not available due to technical reasons, the customer is notified of the expected delivery date. If the customer does not agree with the alternative delivery date, he/she can cancel the order.
Payment for shipping is charged up to the amount of the order 3000,- CZK, if the order is delivered by Zásilkovna.cz, in this case cash on delivery is also possible for a fee of 45,- CZK.

When paying on account, it is necessary to indicate your order number as a variable symbol. The validity of the order is 5 days from the date of ordering, after 5 days the unpaid order will be cancelled.
In the event that logistical reasons force us to send one order in two parts, the customer will be notified and the shipping fee for the second part of the order will be paid by Blue Globe.CZ, s.r.o., or the customer can cancel it.
If you find damage to the package upon receipt of the goods, you have the right to inspect the package at the post office or before the courier to see if the contents are also damaged. If unfortunately the packaging is already damaged, the goods are usually not damaged and do not need to be sent back. If the opposite is the case, then please draw up a claim form with the carrier. In this way you will achieve a quick replacement of the goods regardless of the carrier's statement.
It is advisable to re-inspect the shipment immediately after receipt and unpacking, especially for goods of a more delicate nature to transport. We are not liable for damages caused by the shipment, these must be reported to the carrier immediately and a report drawn up. If the parcel is not obviously damaged and the defect is only discovered when unpacking, it is necessary to draw up a complaint report on the hidden defect with the carrier within 24 hours of receipt. If you do so, we will replace the goods without delay, regardless of whether or not the carrier accepts the claim.
The obligation to inspect the consignment on receipt and to draw up a defect report is an obligation of the buyer, which he agrees to under these terms and conditions.

4/ Withdrawal from the Purchase Contract - Return of Goods
In case of any dissatisfaction, the customer has the right to return the goods in accordance with Act No. 367/2000 of 14 September 2004, even without giving reasons. The customer has this right within 14 days after receipt (acceptance) of the goods. The customer then has the right to demand money or other goods for the goods.
The return means handing over the goods to the carrier for delivery to Blue Globe.CZ, s.r.o., Kalusova 827/10, 709 00 Ostrava - Mariánské Hory. The money for the goods will then be refunded to the customer by transfer to his account within 14 working days of the physical receipt and re-inspection of the goods by the supplier. All postage costs in the case of return of goods by post shall be borne by the customer. If the customer returns the goods by post, he must do so only by registered mail. Sending goods back COD will not be accepted.
In case of return, the goods must be returned undamaged and unused, in their original packaging - the hygienic packaging must not be broken. All documents that the customer received with the goods must also be returned. This is the proof of payment - the invoice. Otherwise, the return cannot be accepted.
If you find damage to the packaging upon receipt of the goods, you have the right to inspect the package in the presence of the carrier to see if the contents are also damaged. Please do so before sending the goods back to our address, in most cases the contents are not damaged. If the goods are damaged, please draw up a claim form with the carrier. 5/ Claims and warranty period

When claiming goods purchased through the www.resonancia.cz e-shop, the Seller shall be governed by the applicable laws of the Czech Republic.

Unless otherwise specified, the Seller provides a warranty period of 24 months (in the case of nutritional supplements, the expiry date is then the expiry date with exceptions provided for in Act No. 634/1992 Coll. The warranty period begins at the time of receipt of the goods. The warranty covers all defects limiting the proper use of the goods.

If the defect is one that can be remedied, the buyer has the right to have it remedied free of charge, in a timely and proper manner, and the seller is obliged to remedy the defect without undue delay. If this is not disproportionate in view of the nature of the defect, the buyer may demand replacement of the item or, if the defect concerns only a part of the item, replacement of that part. 

If such a procedure is not possible, the buyer may demand a reasonable discount on the price of the item or withdraw from the contract.

If there is a defect which cannot be remedied and which prevents the thing from being properly used as a thing without defect, the buyer has the right to have the thing replaced or to withdraw from the contract. The same rights shall apply to the buyer if the defects are removable, but if the buyer cannot use the thing properly because of the recurrence of the defect after repair or because of a greater number of defects.

If the defects are other irremovable defects and the buyer does not request replacement of the item, the buyer is entitled to a reasonable discount on the price of the item or may withdraw from the contract.

The buyer can also make a claim in person at any of the seller's stores in Ostrava at the headquarters of Blue Globe.CZ, s.r.o.

The notification of the claim must include a description of the defect, the order or invoice number and an email or telephone contact to the buyer.

The Seller shall decide on the complaint usually within 5 working days and inform the Buyer by email or telephone.

Unless otherwise agreed by the parties involved, the complaint shall be settled without undue delay, but no later than 30 days from the confirmation of receipt of the notification of the complaint by the Seller. For further information on the progress of the claim, the Buyer may contact eshop@resonancia.cz. (The claim/order number and the Buyer's contact details must always be provided.)

The seller is obliged to issue the customer with a written confirmation of when the consumer exercised the right to claim, what is the content of the claim and what method of handling the claim the consumer requires; the seller is also obliged to issue a confirmation of the date and method of handling the claim or a written justification.

In the event that a consumer dispute arises between us and the consumer under a contract of sale or a contract for the provision of services, which cannot be resolved by mutual agreement, the consumer may submit a proposal for out-of-court settlement of such dispute to the designated entity for out-of-court settlement of consumer disputes, which is: Czech Trade Inspection Authority, Úst řdní inspektorát - ADR Department, Štěpánská 15, 120 00 Prague 2, Email: adr@coi.cz, Website: adr.coi.cz. The consumer can also use the online dispute resolution platform established by the European Commission at: http://ec.europa.eu/consumers/odr/ 

Rejection of a complaint

The grounds for making a complaint are in particular:

Defective goods (e.g.: missing pages of a book, etc.).
Replacement of ordered goods
Shipping of the goods complained about

The buyer shall deliver the claimed goods (including a copy of the invoice) (personally or via carrier) to the registered office of Blue Globe.CZ, s.r.o. (Kalusova 827/10, 709 00 Ostrava-Mariánské Hory). If the complaint is accepted as justified, the buyer will be informed of this fact and after its settlement will be invited to collect the new or repaired goods.

The Buyer shall pay for the delivery of the claimed goods to the Seller. If the complaint is accepted, the Buyer may request reimbursement of the costs associated with the transport of the claimed goods. The Seller shall send the repaired or replaced goods back to the Buyer at its own expense.

Claims for transport of goods.

The subject of the purchase contract (goods) is delivered to the Buyer by an external carrier.

It is always necessary to check whether the shipment has not been damaged in transit directly in front of the carrier when accepting it. In the event that the packaging is in any way obviously mechanically damaged (crumpled, torn, wet, etc.), or if part of the contents of the shipment has obviously been lost, these facts must be claimed from the carrier. The carrier is obliged to immediately draw up a damage report on the extent of the damage or partial loss of the contents of the consignment (it is advisable to take photo documentation).

In case of any problems with the carrier, you must contact the seller at poradna@resonancia.cz. In similar cases, it is always necessary to quote the order number, describe the problem and give contact details of the buyer. It is recommended to put "carrier complaint" in the subject line of the email. 

6/ Privacy Policy
We carefully protect the personal data and information provided against misuse.
These data are only used for the dispatch of the ordered goods and for communication.
The controller of personal data pursuant to Article 4 point 7 of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter: "GDPR") is Blue Globe.CZ, s.r.o., company ID 27810259, with registered office at Kalusova 827/10, 709 00 Ostrava- Mariánské Hory, Czech Republic (hereinafter: "the controller").
By checking off the GTC, I grant my consent to the processing of the personal data provided herein to Blue Globe.CZ, s.r.o. in accordance with Article 4(7) of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter: "GDPR"), Kalusova 827/10, 709 00 Ostrava - Mariánské Hory, for inclusion in the database for the purpose of order processing, marketing, registration of claims for discounts, sending information materials, etc., by electronic means in accordance with Act 480/2004 Coll. for a period of 3 years. 7/ Other arrangements
By placing an order with Blue Globe.CZ, s.r.o., the customer agrees to assume all responsibility for the products purchased and not to use or offer them for purposes other than those for which they are intended and to comply with all applicable laws. By purchasing goods from the Blue Globe.CZ, s.r.o. online store, the customer accepts full responsibility for any damage caused by the misuse or abuse of the products purchased by him/her to his/her health, the health of other persons or damage to property or other damage caused by the misuse or abuse of any products purchased by him/her from the Blue Globe.CZ, s.r.o. online store.

2. the European Consumer Centre Czech Republic, with registered office at Štěpánská 567/15, 120 00 Prague 2, internet address: http://www.evropskyspotrebitel.cz is the contact point under Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013 on online dispute resolution for consumer disputes and amending Regulation (EC) No 2006/2004 and Directive 2009/22/EC (Regulation on online dispute resolution for consumer disputes).

3. The Seller is authorised to sell goods on the basis of a trade licence. The trade control is carried out within the scope of its competence by the competent trade authority. The Czech Trade Inspection Authority supervises compliance with Act No 634/1992 Coll., on Consumer Protection, among other things.
